1/8/2005: During a rainstorm, dining room
window began leaking and flooding the dining and
living rooms.  Calls placed to KHOV, no answer, no
communication
 
1/10/2005:  Communication established with
KHOV.  Tim Taylor walked through the house.  No work
done.  I don't believe anything was done to stop the
leaks.  Check the emails.  Tim Taylor advised that
there must be a supervisor on site at all times to
protect our home, belongings, floor etc.
 
1/12/2005:  American Technologies here for
first time.  Dining room  drywall removed and opened
to air, fans installed to dry area. protection not put
on floor, no containment done.  Mold in bedroom and
discovered.  Drywall removed, no containment put in
place. Fans put in to dry area. Carpet filthy from dry
wall removal.  Wood stair case not protected, and
destroyed.
 
1/13/2005: Moved out of home to hotel.  Wife six
months pregnant, 3 kids 5 and under.  Uncertain what
type of mold is growing and how much is present. 
 
1/13 – 4/4/2005: Family living in hotel. 
Original estimate of time out of home 10 - 14 days. 
Each week a new complication and told " one more
week".
Multiple air samples failed. Multiple water tests
done. All French doors discovered to be leaking.
Outdoor light fixtures and outdoor outlets found to be
leaking. Areas fixed more than one time and water
testing repeated more than once.  
 
4/4 – 4/18/2005:  Family lived in home with
assurance that all leaks had been repaired. 
 
4/18/2005:  Master bath toilet leaking at base. 
Water stains visible in butler's pantry. Cause:  AJ (KHOV Employee)
did not install master bath toilet correctly. Wax ring
was either reused, or proper size was not used. 
Drywall removed, containment established ONLY at
insistence of homeowner.  Homeowner had to instruct
American Tech (Remediation Company hired by KHOV) person on what primary and secondary containment was and why it was necessary.  Mold
discovered in ceiling just below master bath, in
butler's pantry.
 
4/18 – 5/6/2005:  Family living outside the home
again.
 
5/6/2005:  Main part of home declared mold free
again.  Butler's pantry cleaned and remediated more
than once, failed testing more than once in time
family living outside the home.  Family was told that
butler's pantry failed air test by 1 mold spore, that
it was safe to return.  Area was cleaned yet again,
air testing done, containment left in place at
homeowners insistence.  Family moved back into house,
to prepare for new baby.
 
5/13/2005:New baby brought home from hospital. 
Butler's pantry contained as precaution.  
 
Approx 5/20/2005:  Air sample failed in butlers pantry.
Builder says source unknown. Will need to come back
in to discover source.  States is safe to live in
house with baby until work begins while containment in place.
 
 
7/1/2005: Family out of house again to allow work
to continue.
 
7/1 – 8/29/2005:  Family out of home for mold
investigation, discovery and remediation.  Multiple
air tests taken and failed.  Mold found under wood
flooring in area of butler’s pantry.  All cabinets, drywall, countertops and flooring needed to be removed.
 
8/26/2005:  Family received late afternoon call/
early evening that family would no longer be
reimbursed for expenses as home was "habitable". The decision for this was made in a meeting in Orange County by KHOV personnel that had not seen the condition of the house. Not
the case.  Many dangers and filthy - dry wall dust,
mud, razor blades, chemicals etc.  Butlers pantry not
repaired, but had finally passed air test. Many angry phone calls later, pictures taken and video, finally Jim Winovitch was sent to the house, at dark.  Tim Holland had assured us that he was coming in person, but did not.  Jim Winovitch confirmed the dangerous condition of the house, and agreed that it was in fact inhabitable. 
 
9/?/2005 – Moved back in after dangerous conditions cleaned up by KHOV personnel.  Butler’s pantry just drywall.
 
4/15/2006 – Baseboards removed from kitchen and family area to allow tile contractor to install new tile.  Mold discovered just left of the French Doors in Breakfast Nook area.  KHOV notified.
 
4/17/2006 – Remediation company at house to set up containment.
 
4/18/2006 – Family moved out of house to hotel.  Mold discovered to be extensive. French Doors continue to leak.  KHOV to send a forensic construction expert to analyze leaks and to water test areas that were remediated in 2005 kitchen, dining and master bath areas.  
 
4/18/2006  Contech doing water testing.  Mold suspected along wall of kitchen cabinets at back of house.  IH to confirm.  Contech finds multiple construction defects in each of the areas observed.  Multiple leaks detected in moisture barrier at back of house.  One leak detected at dining room window area from nail hole in moisture barrier.
 
4/18/2006 Finding specific locations of water intrusion difficult to locate.  Multiple locations noted due to many construction defects, and disruptions in moisture barrier.  Some water coming from French doors both down and upstairs, some from area where deck is attached to house, some not associated with the windows, doors or deck (those are due to holes in the moisture barrier paper).  It is determined that specific locations cannot be fixed individually.  Virtually entire back wall of house is taken apart down to the frame, repapered, and stucco reapplied.
 
 
4/18/2006-5/12/2006 – Since leaks were detected in each of the areas that had been supposedly corrected in 2005, it was determined that all windows that were also “tested” in 2005 also had defective work.  It was determined that all windows and doors would be retested for water intrusion and possible mold growth.  Originally, we were told that Contech would be directing all testing and remediation.  This changed, and Roel was brought in to do water testing of windows and doors.
 
5/12/2006-6/29/2006  Roel does water testing of windows and doors.  Two additional leaks are detected and repaired.  Multiple nail holes, staple holes, and tears are noted at ALMOST EACH location where drywall is removed around windows and doors. See ROEL report for specific locations and defect type. 
 
6/29/2006-8/31/2006 Multiple cleanings and multiple air samples taken, and fail.
 
9/1/2006 Air test comes back clear.  KHOV notifies family that reimbursement stops. KHOV assured that house would be returned in move in condition. Family inspects house, house filthy with no furniture returned to correct place. Children’s room unrecognizable.  Pictures taken, and sent to  KHOV.  KHOV cannot clean house for 1 week.  Katie Cole assures reimbursement will continue until house is returned as promised.
 
9/14/2006 – KHOV employees AJ Mariano and Jim Winovitch come to replace pantry shelves that were damaged during remediation.  Eric Pearce notices that they have removed drywall from the pantry area.  When he asks about this, he is told that the drywall was accidentally damaged during the removal of a damaged shelf.  They said they removed the piece of dry wall, and now they were going to replace it with a new piece.  The area was inspected by Eric Pearce, and it was noticed that there were two staple holes through the moisture barrier in this location.  It was also noted that there was water staining, rust and mold growth inside the wall on the framing lumber.  KHOV personnel seemed surprised at this finding.  Calls were placed to KHOV management by employees.  Management directed employees to remediate mold themselves without setting up any containment, and to replace drywall.  Homeowners objected, and requested same treatment of this discovery as all other mold discoveries in this house.  This was refused.
 
9/15/2006 KHOV management notifies Pearce’s that they will not be doing air testing, as they have followed the recommendations of the IH and area is deemed clear and safe.
 
9/15/2006 – IH contacted by homeowner.  IH states opinions and recommendations never sought by KHOV in this instance.  When asked his recommendation, he said, containment, remediation, and further air testing were warranted.
 
9/15/2006  KHOV notified of inconsistencies with IH recommendations.  KHOV said all questions to their experts could be addressed on 9/20/2006 in meeting at our house.
 
9/20/2006 Meeting with KHOV rep Wayne Beinhoff, Roel reps, Ron Miller, IH, by phone.  Request made that meeting be recorded.  Roel reps flee meeting.  Ron Miller agrees to recording, and states again that air testing should be conducted.  Wayne Beinhoff agrees with this and tentatively sets up Saturday test date and subsequent meeting with Roel and Ron Miller in person for 1 week.
 
9/22/2006 voice mail received from Wayne Beinhoff that air testing will commence on Saturday 9/23/2006.  Later received second email that scope of testing is being discussed with management.  Later received email that no testing will be done.  Further remediation and air testing has been deemed unnecessary by KHOV.  No KHOV management or remediation or mold experts have visually inspected area of mold growth in the pantry to date.  There is no way of knowing if there is additional growth within the wall or if the area of water intrusion is active or not.  No moisture testing or water testing has been done in the area.
 
 
9/22/2006-3/3/2007 – Summary for these dates is still in process. I am still dealing with the builder on issues and they have not fixed my house!!
